GOING 2 COM

All terms and conditions and the privacy policy of GOING 2 COM are compliant with the regulations and instructions of the General Transport Authority in the Kingdom of Saudi Arabia, and the use of the platform is subject to all relevant laws and regulatory frameworks. This document outlines the obligations and rights of both passengers and drivers (captains) to ensure a safe, reliable, and professional transportation experience.

First: Passenger Obligations

As a user of GOING 2 COM platform services, you agree to fully comply with the following terms to ensure that trips proceed with the highest standards of quality and safety:

1. Compliance with laws and regulations

Traffic regulations: The passenger must fully comply with all applicable traffic regulations while inside the vehicle. Local laws: Strict compliance with local laws within the country where the trip takes place. Prohibition of illegal activities: It is strictly prohibited to use the service or the vehicle for any illegal purpose or activity, or to transport materials prohibited by law.

2. Accuracy and correctness of data

Registration data: The passenger must provide accurate and up-to-date personal data when creating an account on the platform. Trip information: Providing accurate information when requesting a trip (pickup location, final destination, number of passengers). Consequences of manipulation: If false or misleading data is detected, the company has the right to take necessary actions, including immediate account termination.

3. Conduct and public etiquette during the trip

Mutual respect: The passenger must treat the driver with respect and professionalism throughout the trip. No disturbance: It is prohibited to direct any verbal or physical insults or to cause disturbance to the driver while driving. Vehicle preservation: Smoking (of all kinds), consuming food that leaves residue, or performing any acts of vandalism inside the vehicle is prohibited.Important note: Any inappropriate behavior or violation of public etiquette may immediately result in permanent suspension of the passenger’s account, in addition to financial penalties or legal action if necessary.

4. Payment and financial fees Trip fare: The passenger must pay the full trip fare as specified in the application upon completion of the trip. Additional fees: The passenger bears any additional fees that may arise, such as (waiting fees, late cancellation fees, paid toll gates). Payment method: In non-cash systems, payment is automatically deducted from the registered credit card or e-wallet in the account.Important note: In cases of financial disputes, the system relies on accurate electronic records of the application accounts as the primary and final reference for determining the trip value.

5. Cancellation and no-show policy

Late cancellation: If the passenger cancels the trip after the driver has accepted it and proceeded to the location beyond the free allowed time. No-show: If the driver arrives at the specified meeting location and the passenger does not show up within the designated waiting period. Fees: A compensatory “cancellation fee” may be charged and deducted from the passenger’s account in favor of the driver for wasted time and effort.

6. Responsibility for damages

Compensation for damage: The passenger bears full financial responsibility for any material damage caused by them or their companions inside or outside the vehicle. Cleaning fees: The passenger must pay deep cleaning or repair costs if causing unusual contamination of the vehicle (such as liquid spills or vomiting).

7. Personal safety standards

Seatbelt: The passenger (and all companions) must wear a seatbelt throughout the trip in accordance with the law. Safety instructions: Follow any safety instructions provided by the driver or specified in the application to ensure a risk-free trip.

8. Prohibition of misuse of the application

Fake requests: It is strictly prohibited to request fake trips for the purpose of misleading drivers or disrupting the system. System manipulation: The use of any software or technical methods to hack or misuse the application system is prohibited. External communication: Attempting to communicate with drivers outside the application to arrange private trips in violation of the platform policy is prohibited.

Second: Driver (Captain) Obligations

As a partner and certified driver on GOING 2 COM, you represent the primary interface of the service and are committed to the following terms to ensure professional service delivery:

1. Licensing and legal status Driving license: The driver must hold a valid driving license appropriate for the vehicle category being driven. Legal eligibility: Must be legally qualified and authorized to work as a passenger transport driver in accordance with the country’s laws. Traffic compliance: Full and strict compliance with all applicable traffic regulations and road laws.

2. Vehicle condition and maintenance

Safety and suitability: The driver must provide a safe, roadworthy vehicle that complies with platform specifications. Cleanliness and comfort: Maintain cleanliness inside and outside the vehicle, ensure it is free from unpleasant odors, and that the air conditioning system operates efficiently. Periodic maintenance: Conduct regular inspections and maintenance to avoid unexpected breakdowns during trips.

3. Commitment to trip execution

Service execution: The driver must commit to performing and completing the trip once accepted via the application. Punctuality: Proceed immediately to the passenger’s location and arrive at the specified or estimated time via the navigation system. Prohibition of arbitrary cancellation: Cancelling trips after acceptance without a substantial or force majeure reason is prohibited.

4. Professional and ethical conduct

Professional behavior: The driver must deal with all passengers respectfully, politely, and with high professionalism. Non-discrimination: Discrimination based on race, gender, religion, or destination is prohibited, as well as any verbal or behavioral abuse. Consequences of violation: Any complaint regarding professional conduct may lead to immediate investigation and temporary or permanent suspension of the driver’s account.

5. Route and pricing compliance

Optimal route: The fastest and most appropriate route determined by the GPS system must be followed, unless the passenger requests a specific route that does not violate laws. Pricing transparency: Manipulating prices or requesting additional cash amounts not included in the final application invoice is prohibited.Important note: The platform relies on automatic data recording (via satellites) to track trip routes and accurately determine costs, and any attempt to manipulate the route will be detected by the system.

6. Safety and security standards while driving

Safe driving: Compliance with speed limits and avoidance of reckless driving that may endanger the passenger’s life. Distractions: It is strictly prohibited to use a mobile phone for messaging or browsing while driving. Safety measures: Ensure seatbelts are functional and instruct passengers to use them.

7. Handling accidents and breakdowns

Immediate reporting: In the event of a traffic accident (God forbid), the company support must be notified immediately via the application. Security cooperation: Full cooperation with security and relevant authorities and providing all required information.Important note: Failure to report the accident to the company or authorities may result in the driver bearing full legal and financial responsibility.

8. Responsibility for traffic violations

Personal responsibility: The driver is fully responsible for any traffic violations recorded on the vehicle during the trip (such as speeding, running a red light, illegal parking). Payment of fines: The driver must bear all financial penalties resulting from poor driving or violation of regulations.

9. Proper use of the application

Exclusive use: The driver must use the application only for official work and receiving requests. Fraud prevention: Misuse of the system is prohibited (such as sharing the account with others or using programs to falsify geographic location).Important note: The company monitors account activity and may permanently suspend the driver’s account without prior notice if any fraud or violation of the terms of use is detected. ⚖ Important Legal Notes

Nature of the relationship: GOING 2 COM operates as a technical intermediary connecting the passenger (service requester) and the driver (independent service provider), and drivers are not considered employees of the company. Limitation of liability: The company does not bear direct legal or financial responsibility for traffic accidents, damages, or personal disputes that occur between the passenger and the driver, and such cases are subject to the laws of the state. Platform rights: The company reserves the full right to suspend, deactivate, or ban the account of any party (passenger or driver) proven to have violated these terms and conditions in order to ensure the safety of the user community.

Summary of Terms and Conditions

Passenger: Fully responsible for behavior inside the vehicle, the accuracy of submitted data, payment of trip fees, and respecting the driver and the vehicle. Driver (Captain): Responsible for providing a safe trip, maintaining vehicle cleanliness and condition, driving professionally, and delivering service that meets platform standards. Company (GOING 2 COM): Acts as a regulatory and technical intermediary that enforces rules, monitors quality, and provides a safe communication environment between both parties to protect everyone’s rights.
